Warranties

Statutory warranties

All products available for sale on the website benefit from the statutory warranty of conformity (as defined in articles L. 217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (as defined in articles 1641 et seq. of the French Civil Code), allowing the buyer to return, free of charge, defective or non-conforming products delivered to him/her.

1.1 Statutory warranty of conformity

The French Consumer Code provides the following in terms of the statutory warranty of conformity:

Article L. 217-4:

“The seller is required to deliver goods that conform with the contract and is liable for any defects in conformity existing at the time of delivery. The seller is also liable for defects in conformity resulting from packaging, assembly instructions or installation if the seller was responsible for the installation under the contract or if the installation was carried out under its responsibility.”

Article L. 217-5: “In order to conform with the contract, goods must:

  • Be fit for the purpose ordinarily expected of similar goods and, as applicable:

  • correspond to the description provided by the seller and possess the qualities the seller presented to the buyer in the form of a sample or model;

  • have the qualities a purchaser may legitimately expect in view of the public representations made by the seller, by the producer or by its representative, notably in advertisements or labelling;

  • Or, have the characteristics mutually agreed between the parties or be fit for any special use sought by the buyer and brought to the seller’s attention and which the seller accepted.

Article L. 217-12: A suit resulting from a defect in conformity becomes time barred two years after the delivery of the goods.

1.2 Warranty against hidden defects

The French Civil Code provides as follows with respect to the warranty against hidden defects:

Article 1641 of the French Civil Code: “The seller is bound by a warranty against hidden defects in the thing sold that render it unfit for its intended use, or that so diminish such use that the buyer would not have bought it, or would only have paid a lower price for it if had it known of the defects.”

Article 1648 of the French Civil Code: “An action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect. In the case provided for by article 1642-1, the action must be brought, under penalty of being time barred, within the year that follows the date on which the seller can be discharged of apparent defects or apparent defects in conformity.”

Within the framework of the warranty against hidden defects, Aesop undertakes to, after assessing the defect and at your option:

  • either reimburse you the full price of the returned product, or

  • reimburse you part of the product price if you, the buyer, decide to keep the product.

1.3 Warranty exclusions

Products that are modified, repaired, integrated or added by the buyer are not covered by the warranty. The warranty does not cover products that were damaged during shipping or from improper use.

Warranty claims

In the case of the statutory warranty of conformity, the buyer:

  • has two years as from the delivery of the goods to act;

  • may choose between the repair or the replacement of the goods, subject to the cost conditions contemplated by article L. 217-9 of the French Consumer Code;

  • is exempted from providing proof of the existence of the defect of conformity of the product for the total duration of the statutory warranty of conformity ( 2 years following the delivery of the goods).

The buyer may decide to make a warranty claim in respect of hidden defects in the thing sold within the meaning of article 1641 of the French Civil Code. In such a case, the buyer may choose between the cancellation of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.

If you have any questions regarding statutory warranties, you can contact Customer Service through the “Contact us” section of Aesop’s website or by telephone (+33 1 20 16 14 95 (service free + price of call).

These provisions are not exclusive of the right of withdrawal defined below.

Consequence of a warranty claim

In the context of the statutory warranty of conformity, Aesop undertakes to, at the buyer’s option:

  • either replace the product with an identical product depending on available inventory, or

  • reimburse the product price if it is impossible to replace a product.

In the context of the statutory warranty against hidden defects, Aesop undertakes to, after assessing the defect and at your option:

  • either reimburse the full price of the returned product, or

  • reimburse a portion of the product price if the buyer decides to keep the product.

Withdrawal rights and time periods

In accordance with article L. 221-18 of the French Consumer Code, the Buyer has 14 (fourteen) days starting on the date the package containing the ordered products is received to exercise his/her statutory right of withdrawal without having to provide a reason for his/her decision.

The right of withdrawal cannot be exercised in respect of Orders relating to:

  • the supply of goods that were unsealed after delivery and that cannot be returned for hygiene or health reasons;

  • the supply of goods produced according to the consumer’s specifications or that were clearly personalised.

The Buyer is thus informed that Products that are unsealed after delivery and that cannot be returned for hygiene or health reasons cannot benefit from the right of withdrawal (in particular, and without this list being exhaustive, a cosmetic product whose seal has been removed).

These provisions apply without prejudice to the statutory guarantees provided for in these Terms of Trade, which remain applicable in full.

A Buyer exercising his/her right of withdrawal under the conditions provided for in this article in terms of timing and methods of returning products may obtain a refund for the returned products and for Order delivery fees (at standard cost) in accordance with article L. 221-24 of the French Consumer Code. If a portion of the Order is returned, Aesop will reimburse delivery fees proportionally to the number of items returned, except in the case of flat-rate delivery fees.

Unless the Buyer expressly agrees to another means of reimbursement, the Product(s) shall be reimbursed without excessive delay using the Buyer’s original payment method and, in any event, no later than fourteen (14) days of the day on which  Aesop is informed of the Buyer’s decision to withdraw. This refund will be free of charge for the Buyer. The reimbursement of this amount may, however, be deferred until the returned Products are actually recovered or until the Buyer has provided proof of shipment of the Product, and the date applied will be the date of the first of these events to occur.

In accordance with Article L221-23 of the French Consumer Code, it is specified that Aesop shall not bear the cost for returns made if, due to the nature of the products, their return can be carried out normally by post, in which case such return costs shall remain the responsibility of the Buyer or the Order recipient.

The Buyer or, as appropriate, the recipient of the Order, must inform Aesop of his/her wish to withdraw in one of the following ways:

  • contacting Aesop’s Customer Service within 14 (fourteen) days after the Order. In such a case, the Buyer can notably use the model withdrawal form attached to these Terms of Trade and send it to the following address; Aesop SAS, 83 rue Saint Honoré, 75001 Paris, or via email through the “Contact us” area of Aesop’s website.

In such a case, the Client is informed that it is not technically possible for Aesop to stop the shipment of the products once the Order has been approved. The Order will then be sent to the Buyer and the Buyer undertakes to, in accordance with article L. 221-23 of the French Consumer Code, return the products in question within fourteen (14) days after having informed Aesop. If the products are received after this fourteen (14) day period, Aesop will be deemed to have been informed by the Buyer of his/her intention to withdraw at the time the products were actually sent by him/her.

  • return the products in question in one of Aesop’s stores located in Metropolitan France or by post (letter, package, etc.) as described hereafter. No returns at parcel drop-off points are accepted.

General provisions applicable to all return methods (in store or by post):

The products must be returned to Aesop in a condition that is suitable for a new sale (products in perfect condition accompanied by their original packaging, accessories, instructions, etc.) within fourteen (14) days of the date on which the Buyer informed Aesop of its decision to withdraw and no later than fourteen (14) days following the date they were received. Returns of products sent back after this deadline will not be accepted. The products must also be accompanied by the Order number written either on the Return Form sent with the delivered products and signed by the Buyer or the Order recipient, or on any other document. The Buyer and the Order recipient (if different from the Buyer) are informed that the use of the Return Form facilitates Aesop’s processing of the return. The Buyer or the Order recipient (if different from the Buyer) is therefore invited to use this Return Form.

If on the website the Buyer benefited from an offer against purchase giving him/her the right, under certain conditions, to one or more free products in return for his/her Order and, due to the exercise of his/her right of withdrawal the Buyer is no longer eligible for the offer in question, the Buyer must send the product(s) he/she wishes to return along with the free product(s) received in exchange for the Order of the returned product(s) so that Aesop can take his/her withdrawal request into account.

The Buyer may be held liable if the product is degraded as a result of handling other than what is necessary to establish the nature, characteristics and, as appropriate, the proper functioning of the products.

Special provisions applicable to in-store returns:

In-store returns are possible at all Aesop stores in Metropolitan France, subject to presenting proof of the amount of the returned Order (for example, an e-mail confirming the Order, invoice, etc.).

Special provisions applicable to postal returns:

A Buyer or Order recipient who wishes to exercise his/her withdrawal right by returning a product by post must contact us.

Aesop does not accept any packages or letters sent postage due.

If the Buyer or Order recipient does demonstrate that he/she actually insured the deposit of the product with a carrier or a store, any risk related to the return of a product shall be borne by the Buyer or Order recipient.

Aesop undertakes to reimburse the Buyer for all amounts paid, including delivery fees (with the exception of additional delivery fees resulting from the fact that the Buyer has selected, as the case may be, a delivery method other than the least expensive standard delivery method offered by the Seller).
